Terms and Conditions

1. Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry. Entry is via email.

2. Entry is open to all Australian and New Zealand permanent residents. Employees and their immediate families of Overstock Outlet Pty Ltd (oo.com.au) and printers, suppliers, providers and agencies associated with this promotion are ineligible.

3. The promotion commences on 1^st August at 9.00am (AEDT) and concludes on 30^th September 2008 at 5.00pm (AEDT).

4. To enter the promotion, participants that receive an email from OO.COM.AU, Velocity Rewards or any 3^rd Party during the promotional period must:

a) complete their details where required and submit electronically

b) upon submitting their details, consumers may also ‘refer a friend’ by entering their friend’s email address to gain additional entries into the draw

Entrants must be 18 years of age or over to enter.

5. Each additional ‘refer a friend’ email address that a participant records (after they have entered their own details) will entitle them to an extra entry into the draw.

Entrants can only enter in their own name and use their own email address. The Promoter reserves the right to request winners to provide proof of age, identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.

6. OO.COM.AU is entitled to confirm that referrals that resulted in the entrant obtaining additional entries into the draw are genuine, in that there is not a substantial number of hard bounces when confirming the authenticity of the referral email addresses. OO.COM.AU will investigate authenticity for each winner of the competition.

OO.COM.AU reserves the right to verify the validity of entries and to disqualify any entrant (including a winner) who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions or who has, in the opinion of OO.COM.AU, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.

7. It is a condition of entry to this competition that entrants consent to their name, email address and postcode being retained by oo.com.au for the purposes of advising them of the winners of this competition, issuing them with free shopping coupons, and for the purposes of emailing notifications of similar competitions and special offer promotions.

8. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.

9. The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider.

10.The prize draw will take place at MDSA,15 Grosvenor Street, Neutral Bay NSW 2089 on 7^th October 2008 at 10:00am. There are a total of 102 prizes to be drawn. All winners will be notified by email and the winners of prizes over $100 in value will be published in The Australian newspaper on 14^th October 2008.

The Promoter reserves the right to redraw in the event of any entrant being unable to satisfy these competition conditions or forfeiting or not claiming the prize. If a prize choice remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct further draws, as required, at the same time and place as the original draw on 23^rd January 2009. The winner/s will be notified by email and published in The Australian newspaper on 30^th January 2009.

11.PRIZES

Grand Prize:

1 Million Velocity Reward Points

The first eligible entry drawn will win the Grand Prize of 1 Million Velocity Points.

The winner of the 1 Million Points will be required to be a Member or join Velocity Rewards.

Velocity will add the Bonus Points into the qualifying Velocity Members Account within 4 weeks of receiving notification of winner’s details (including correct Velocity membership Number and winner's full name as appears on their Velocity Membership Account)  from oo.com.au.

Velocity Rewards and oo.com.au do not accept responsibility for any incorrectly entered Velocity Membership Number

Velocity Membership and Points earn and redemption are subject to Velocity Terms and Conditions as amended from time to time, and available online at www.velocityrewards.com.au

Velocity Rewards Pty Ltd is a prize provider for this competition and is not responsible for, or involved in, the conduct of the competition, the draw and/or the allocation of prizes

The Velocity Program is operated by Velocity Rewards Pty Ltd ACN 116 089 448 as trustee of The Loyalty Trust.

oo.com.au and Velocity/Virgin Blue Employees are not eligible to enter this competition

The prize is non-redeemable for cash.

TOTAL PRIZE POOL = $33,687

12. The Grand Prize winner and their travel companions are responsible for all expenses not covered by the Velocity Points including spending money, meals, drinks, transfers, activities, incidentals, taxes (including departure taxes), fuel and security surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.  Travel insurance is highly recommended.

13. Government taxes and levies imposed by airlines and other transport organisations are additional costs and are the responsibility of the winner. 

14. It is the winner and their travel companions’ personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winner and their travel companions.

15. Overstock Outlet Pty Ltd, Velocity Rewards Pty Ltd and any organisation that is involved in this promotion make no representation as to the safety, conditions or other issues that may exist at any destination.  International travel advice should be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade prior to and during your travels.

16. Consolation prizes will be shipped by oo.com.au to winners’ addresses within Australia and New Zealand only. Bulky items will not be shipped to New Zealand – in the case where a bulky item prize is won by a New Zealand resident this will be exchanged for a Gift Coupon to the same value as the selling price of that prize on oo.com.au.

17. If the prizes are unavailable, for whatever reason, the Promoter reserves the right to substitute any of the prizes for a prize of equal or greater value, subject to state regulation and subsequent approval.

18. Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all valid prize claims in excess of the advertised prize pool will be honoured.

19. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.

20. All existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.

21. Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.

22. The prize must be taken as offered and cannot be varied. Prizes are non-redeemable for cash and are not able to be exchanged for other products.

23. The Promoter’s decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.

24. All prize items are valued inclusive of GST. Prize values are based upon the average prices of these prize items in retail stores at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the date that the prizes are awarded.

25. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoter's premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.

26. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize including the winner’s image. The winner acknowledges that the Promoter is free to use such image and to exercise its rights in relation thereto (including advertising or marketing thereof, in any media whatsoever throughout the world) and the winner will not be entitled to any fee for such use.

27. Prize winners are advised that Tax implications may arise from their prize winning and they should seek independent financial advice prior to the acceptance of the prize.

28. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

29. The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

30. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

31. All entries become the property of The Promoter. All entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for the purposes of advising them of the winners of this competition, issuing them with free shopping coupons, emailing notifications of similar competitions and special offer promotions, future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid. By entering the promotion, entrants confirm that they allow their details to be used for this purpose. If entrants do not consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter. To ensure your privacy is protected, there will be an ‘unsubscribe’ link, at the top of each such communication, which if selected by the entrant, will result in oo.com.au immediately ceasing to send the entrant these communications. oo.com.au will not provide entrants details to any third parties including Velocity Rewards, Virgin Blue, suppliers, providers and agencies associated with this promotion or any other party.

32. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the promotion.

33. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.

Additional comments:

Regardless of whether they are a winner or not, every entrant will receive a free $5 Gift Coupon which may be used to purchase any product at www.oo.com.au.

Each entrant will receive an additional free $5 Gift Coupon for every person they refer to the promotion. There is no limit to the number of free Gift Coupons they can receive. The Promoter reserves the right to disqualify entrants and withhold free Gift Coupons if, in the opinion of the Promoter, the referred persons are not genuine.

The Coupons are transferable. Only one Coupon may be redeemed per transaction and may not be used with any other Coupon promotion. The Coupons are valid to 31^st December 2008. Coupons will be issued fortnightly during the promotion, as entries and referrals are completed. Final Coupons will be issued by 15^th October 2008.
